{"id":91,"date":"2006-05-11T22:50:26","date_gmt":"2006-05-12T05:50:26","guid":{"rendered":"http:\/\/stephendanko.com\/blog\/2006\/05\/11\/the-certificate-of-arrival\/"},"modified":"2016-05-22T17:02:20","modified_gmt":"2016-05-23T00:02:20","slug":"the-certificate-of-arrival","status":"publish","type":"post","link":"https:\/\/stephendanko.com\/blog\/91","title":{"rendered":"The Certificate of Arrival"},"content":{"rendered":"<p>My grandfather, Kostanty Niedzialkowski, filed\u00c2\u00a0his Declaration of Intention to become a citizen of the United States in 1917 .\u00a0 The Declaration was required by the Act of January 29, 1795.<\/p>\n<p>A few years before Kostanty arrived in the United States, immigration and naturalization laws were amended by the Act of June 29, 1906 .\u00a0 This act\u00c2\u00a0did not specifically require a Certificate of Arrival,\u00a0nor did\u00c2\u00a0it\u00c2\u00a0not specifically mandate that the applicant legally enter the United States .\u00a0 The courts, however, generally\u00c2\u00a0refused to accept\u00c2\u00a0a Declaration of Intention without\u00c2\u00a0verification that the applicant entered the country legally .\u00a0 The Act of March 2, 1929 included a requirement to\u00c2\u00a0verify that the applicant was a lawful permanent resident through a Certificate of Arrival .\u00a0 Passenger Arrival Manifests were searched and information on the manifests was used to generate\u00c2\u00a0a Certificate of Arrival.<\/p>\n<p align=\"center\"><a class=\"imagelink\" title=\"Helen and Kostanty Niedzialkowski\" href=\"https:\/\/stephendanko.com\/blog\/wp-content\/uploads\/2006\/05\/Niedzialkowski_Wedding.jpg\"><img loading=\"lazy\" decoding=\"async\" id=\"image94\" style=\"width: 335px; height: 491px;\" src=\"https:\/\/stephendanko.com\/blog\/wp-content\/uploads\/2006\/05\/Niedzialkowski_Wedding.jpg\" alt=\"Helen and Kostanty Niedzialkowski\" width=\"335\" height=\"491\" \/><\/a><\/p>\n<p align=\"center\">Above:\u00a0 Helen and Kostanty Niedzialkowski<\/p>\n<p>Whether Kostanty had difficulty obtaining a Certificate of Arrival or just became too busy after marrying Helen Meleski (Chmielewski), raising a family, and earning a living, he failed to complete the naturalization process in a timely manner .\u00a0 The Declaration of Intention he filed in 1917 stated that the declaration was &#8220;Invalid for all purposes seven years after the date hereof&#8221;, and so he had to start the naturalization process all over again.<\/p>\n<p align=\"center\"><a class=\"imagelink\" title=\"Certificate of Arrival\" href=\"https:\/\/stephendanko.com\/blog\/wp-content\/uploads\/2006\/05\/Certificate-of-Arrival.jpg\"><img loading=\"lazy\" decoding=\"async\" id=\"image92\" style=\"width: 446px; height: 300px;\" src=\"https:\/\/stephendanko.com\/blog\/wp-content\/uploads\/2006\/05\/Certificate-of-Arrival.jpg\" alt=\"Certificate of Arrival\" width=\"446\" height=\"300\" \/><\/a><\/p>\n<p>On April 5, 1935, a Certificate of Arrival was issued to certify that Kostanty\u00c2\u00a0had been\u00c2\u00a0lawfully admitted to the United States of America .\u00a0 The Certificate states:<\/p>\n<ul>\n<li>Name:\u00a0 Niedzialkoski, Konstanti<\/li>\n<li>Port of entry:\u00a0 New York, NY<\/li>\n<li>Date:\u00a0 May 24, 1910<\/li>\n<li>Manner of arrival:\u00a0 SS Ryndam<\/li>\n<\/ul>\n<p>The upper edge of the Certificate\u00c2\u00a0appears to be\u00c2\u00a0perforated, suggesting that the Certificate was torn from a larger sheet.<\/p>\n<p>The\u00c2\u00a0<a href=\"https:\/\/stephendanko.com\/blog\/wp-content\/uploads\/2006\/05\/IMM-Niedzialkoski-Konstanti-1910.pdf\">Passenger Arrival Manifest of Konstanti Niedzialkoski<\/a> included the annotation <em>1-151593- 4\/5\/35<\/em> in the Occupation\u00c2\u00a0column .\u00a0 The first number is the naturalization district number, the second number is the number of the Certificate of Arrival, and the date is the date of issuance of the Certificate .\u00a0 This annotation corresponds to the correponding number and date on the Certificate itself .\u00a0 The U.S. Citizenship and Immigration Services website list several <a href=\"https:\/\/stephendanko.com\/blog\/268\">annotations<\/a> to the Passenger Arrival Manifests.<\/p>\n<p>Because Kostanty&#8217;s Declaration of Intention had expired, he submitted a new Declaration on April 27, 1935 .\u00a0 The <a href=\"https:\/\/stephendanko.com\/blog\/wp-content\/uploads\/2006\/05\/IMD-Niedzialkowski-Kostanty-1935.pdf\">new Declaration of Intention of Kostanty Niedzialkowski<\/a>\u00c2\u00a0includes a wealth of information not included on the Declaration he made in 1917 .\u00a0 It includes:<\/p>\n<ul>\n<li>His residence\u00c2\u00a0at 44 Byron St., Worcester, Worcester Co., Massachusetts<\/li>\n<li>His occupation as a Machinist and the fact that the second and third fingers of his right hand were injured<\/li>\n<li>A description of him as male, white, medium complexion, blue-gray eyes, blonde hair, height 5 feet 9 inches, and weight of 190 pounds<\/li>\n<li>His Polish-Russian ethnicity and his polish nationality<\/li>\n<li>His birth\u00c2\u00a0on October 28, 1892 in Pomocki, Lomza, Poland<\/li>\n<li>His marriage\u00c2\u00a0to Helen Meleski on July 10, 1918 in Worcester, Massachusetts<\/li>\n<li>Helen Meleski&#8217;s birth on February 15, 1897 in Likisski, Vilna, Poland and her entry into the United States at New York, N.Y. on January 14, 1913<\/li>\n<li>The names and birthdates of his five children: Natalie, Raymond, Jane, Fred, and Henry, all born and residing in Worcester<\/li>\n<li>His emigration from Rotterdam, Netherlands on the SS Ryndam and arrival in New York, NY on May 24, 1910<\/li>\n<li>His prior Declaration of Intention No. 12755\u00c2\u00a0on June 2, 1917 in the Massachusetts Superior Court<\/li>\n<li>His photograph and signature<\/li>\n<li>A reference to his Certificate of Arrival No. 1-151593<\/li>\n<\/ul>\n<p>Kostanty now had to wait another three years to file his Petition for Naturalization, and if he did not file within seven years, this Declaration of Intention, too, would become invalid.<\/p>\n<p>Next:\u00a0 Kostanty files his Petition for Naturalization, obtains Affidavits of Witnesses, and signs an Oath of Allegiance.<\/p>\n<p style=\"text-align: center;\">Copyright \u00a9 2006 by Stephen J.
